General terms and conditions for the use of the MyStagePlan web application (1-7-2013)
Article 1 Definitions
A user account that is accessible through the website by entering a user name and password.

The MyStagePlan service through which De Popunie allows users to create a stage plan and share it via the online database MyStagePlan.com
The natural or legal person using the Service.
The information that De Popunie provides to its users through its website in the framework of the Service.
The conditions specified below.
The website MyStagePlan, available at www.MyStagePlan.com.
Article 2 Applicability
These General Terms and Conditions apply to the use of the Website, the Service and the Information.
De Popunie reserves the right to unilaterally modify these General Terms and Conditions without prior notification. De Popunie will inform registered users accordingly via the email address known to De Popunie. The changes will immediately enter into effect upon the publication of the new General Terms and Conditions on the Website.
Article 3 Use of the service
De Popunie cannot guarantee that the Website and the Service will function without limitations or disruptions at any time. De Popunie strives to remedy such disruptions and limitations as quickly as possible and to minimise any resulting inconvenience for Users.
De Popunie cannot be held liable for damage that directly or indirectly results from, or is associated with the use or inability to use the Website or the Service.
De Popunie is entitled to put the Service temporarily out of operation or to limit its use without prior notice if it deems such necessary. De Popunie cannot be held liable for any damages resulting directly or indirectly from the Website being out of operation or limitations of its use.
The User indemnifies De Popunie against any claims by third parties related to information derived from the User or any other use of the Website, the Information or the Service by the User.
The User is not allowed to activate processes or let them continue to exist if he or she can in all reason suspect they will hinder other Internet users or negatively impact the use of the Website or Service.
Article 4 Intellectual property rights
Unless otherwise indicated on the Website or in the General Terms and Conditions, all rights, including copyrights and other intellectual property rights, regarding the Website and the Information rest with De Popunie.
The User may consult the Website and the Information and create or have created copies of these for his/her own use, e.g. by printing or saving them. Every other use of the Website or the Information, including, but not limited to, the reproduction, copying, sales or use for commercial purposes of the Information or the inclusion of deep links between the Website and any other Internet page is prohibited.
The User is not allowed to reproduce or block the use of, or access to the Website or Service, with the exception of the stage plan created by the User using the Website.
Article 5 Prices and payment for the service
The Service is provided based on the rates indicated or described on the Website. These will remain valid until the publication of modified rates by De Popunie on the Website.
The amount the user must pay De Popunie is paid prior to De Popunie’s delivery of the stage plan, using one of the payment methods indicated on the Website.
Article 6 Privacy
To use the Service, the User will have to create an Account and enter his or her personal details for this purpose. This information will only be visible to other users of the Service if the User has flagged his or her stage plan as public in MyStagePlan’s database. If the User flags his or her stage plan as public, the only information that will be visible are the band’s web address, e-mail address and phone number.
Data that could be measured or collected from using the Service will only be processed anonymously and used for the purpose of optimising the Service.
Article 7 Applicable law
These General Terms and Conditions are exclusively governed by Dutch law.
